Acceptance of Terms

These Terms of Service govern your use of the website videofaceswapper.com and the AI video service offered on it (together, the "service"), operated by Video Face Swapper ("we", "us"). They apply to every visitor and every account. By accessing or using the service you agree to these terms. If you do not agree, do not use the service.

Description of Service

You upload a short video (or pick a template) and one or more photos, and the service generates a new video in which either only the face is replaced (Face Swap, Multiple Faces, GIF Face Swap) or the whole person is replaced (Character Swap). Videos are generated by third-party AI models on our behalf (see "AI Models We Use").

The service only re-uses the motion and sound of the video you provide. You cannot type a prompt or script, and the service does not generate speech, clone voices or change what anyone says.

We may modify, suspend or discontinue any part of the service, with reasonable notice where possible.

Eligibility and Accounts

You must be at least 18 years old to use the service. You need an account (Google sign-in or email) to generate videos. You are responsible for keeping your login secure and for all activity under your account. Tell us promptly about any unauthorized use.

Your Uploads and Consent

You may only upload videos and photos that:

• show yourself, or people who have given you their permission to be used this way;
• you own or have the right to use;
• do not show anyone under 18; and
• do not show a public figure, such as a celebrity, politician or official, unless it is you.

Before every generation you must confirm these conditions and consent to us and our providers processing the facial features in your uploads to create the video and to estimate the age of the people shown (see the Privacy Policy, "Biometric Information"). Our website and our server both reject a generation without this confirmation.

You keep ownership of your uploads. You grant us a limited licence to store, process and transmit them, including to our AI providers, only to provide the service to you. We do not use your uploads or generated videos to train AI models and we do not sell them.

Our Commitment Against Deepfake Misuse

Face and character swapping can be misused to deceive, harass or sexually exploit real people. We built the service for consensual, creative and entertainment use, and we hold these lines without exception:

• No sexual content of anyone, and no nudity.
• No content involving minors.
• No use of a real person's likeness without their consent.
• No impersonation, fraud or deception, including fake endorsements, scams, identity-verification bypass, and political or election disinformation.

These are the safeguards in place today:

1. Consent before every job. You must confirm that you own the uploads or have the permission of everyone shown, that nobody is under 18, and agree to these terms. Without this confirmation the job is not created.

2. No prompts and no voice generation. The output follows the motion and audio of the video you upload. There is no free-text prompt, no speech synthesis, no voice cloning and no lip-syncing to new words, so the service cannot make anyone say something new.

3. Three automated checks on every job.

   • Source video: checked for nudity and sexual content before any AI processing.
   • Photos: checked for nudity and sexual content, plus an automated age estimate of every face. Photos that appear to show a minor, or in which no face can be found, are rejected.
   • Generated result: checked again for nudity and sexual content before it is delivered or can be shared.

   A job that fails any check is stopped, the result is never delivered, and the credits are refunded. Every check result is logged.

4. Repeat violations block the account. An account with three blocked jobs within 30 days can no longer create videos.

5. Visible AI labels. Free-trial videos carry a large "videofaceswapper.com · AI generated" watermark. For paid plans, previews and public share pages carry an "AI generated" mark. Paid plans can download an HD file without a visible mark; when you share it, you must disclose that it is AI-generated and follow the AI-content labelling rules of the platform you post on. Do not remove our marks or present any output as real footage.

6. Reporting and removal within 48 hours. Anyone can report content (see "Reporting Content and Takedowns"). We review every report by hand and delete confirmed content from our storage.

7. Cooperation with authorities. We keep moderation records, report child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement as required by law.

No automated check is perfect. If something gets through, report it and we will act on it.

Prohibited Uses

You may not use the service, or videos made with it, to create, upload or share content that:

• is sexual or sexually suggestive, involves nudity, or is intimate imagery of anyone;
• shows, sexualises or targets anyone under 18;
• uses a real person's likeness without their consent;
• impersonates anyone, or deceives people about who appears in a video or about real events;
• impersonates public figures, politicians or officials, or is political or election disinformation;
• is used for fraud, scams, fake endorsements, or to bypass identity verification;
• harasses, bullies, threatens, defames or humiliates anyone;
• is hateful or violent, or encourages violence or self-harm;
• infringes copyrights, trademarks, or privacy or publicity rights; or
• breaks any applicable law.

You also may not bypass or attempt to bypass our safety checks, watermarks, age checks or usage limits, access our systems without authorization, or use automated means to abuse the service.

AI Models We Use

• Character Swap: Wan 2.2 Animate, an open video model by Alibaba, accessed through WaveSpeed.
• Face Swap, Multiple Faces and GIF Face Swap: the face-swap model of Magic Hour, accessed through its API.
• Content checks: nudity and sexual-content detection by SeeAPI; face detection and age estimation by Amazon Rekognition.
• Video processing: format conversion, watermarking and cover images run on our own media server.

If we change these models we will update this section before the change takes effect. AI output can contain mistakes or visual artefacts; review it before sharing.

Reporting Content and Takedowns

What to report: any video made with the service that uses your likeness without consent, involves a minor, is sexual, impersonates someone, infringes your rights or otherwise breaks these terms.

How to report:

• Click Report on any shared video page, or use the form at /takedown; or
• email abuse@videofaceswapper.com with the video link (for example https://videofaceswapper.com/v/...) and a short description.

Copyright notices follow our DMCA Policy.

How we handle reports: every report is reviewed by a person within 48 hours. When a report is confirmed, we delete the video and all its files from our storage, disable its share link, and act on the account according to the severity:

• Critical (sexual content of a real person, anything involving a minor): content removed, account terminated, and reported to the authorities where required.
• High (likeness used without consent, impersonation, fraud, harassment): content removed and account suspended or terminated.
• Other breaches: content removed and a warning issued.

We keep the identity of the person reporting confidential and record false or malicious reports.

Generated Videos

Subject to these terms and to the rights of the people and works in your uploads, you may use the videos you generate. You are responsible for how you use and share them, including obtaining any permissions needed from the people shown and labelling them as AI-generated.

Credits, Subscriptions and Payments

• Generations cost credits, based on the effect and video length. The cost is shown before you start. Failed or blocked generations are refunded automatically.
• Plans (weekly or monthly) renew automatically until cancelled. Plan credits are valid for the billing period in which they are granted. Credit-pack credits do not expire.
• You can cancel a plan at any time from Settings → Billing; you keep your plan until the end of the period you paid for.
• Orders are processed by our online reseller and Merchant of Record, Waffo Pancake, who is the seller of record for your purchase and also handles order-related inquiries and returns. We do not receive or store your full card or bank details.
• Refunds are described in the Refund Policy.
• Free sign-up credits are limited to one gift per person and network. We may withdraw credits obtained through abuse.

Intellectual Property

The service, including its software, design and brand, belongs to us. These terms do not give you any rights in the service other than using it as described here. If you hold rights in content used on the service, contact us or use the DMCA Policy.

Termination

We may suspend or terminate access at any time for violations of these terms or the law. Unused credits are not refunded when an account is terminated for violating these terms. You may stop using the service at any time and ask us to delete your account.

Disclaimers and Limitation of Liability

The service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. To the maximum extent permitted by law we are not liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Changes to These Terms

We may update these terms. We will post the new version on this page and change the date above; material changes will also be announced on the site. Continued use after changes means you accept them.
